This policy explains how Fathom Limited ("we", "us") collects, uses and protects your information when you use our website and our mobile apps (the "Services"). We are the data controller. Our address is Suite C, Level 7, World Trust Tower, 50 Stanley Street, Central, Hong Kong.
1. What we collect
- Account details: your name, email address and sign-in details.
- Health and wellness information you choose to enter: goals, daily check-ins and ratings (for example energy, sleep or mood), symptoms, weight, waist measurement, habits, notes, and any test results you add yourself.
- Subscription information: your plan, trial status and renewal dates, received from Apple or Google. We never see or store your card details.
- Usage and device information: which features you use, app version, device type, operating system, crash reports and a device identifier.
- Messages you send us through support email.
2. How we use it
- To provide the Services: save your entries, show your progress, send the reminders you set up.
- To manage your subscription and account.
- To fix problems and improve the app, using usage and crash data.
- To reply to you when you contact us.
- To meet legal obligations and protect against fraud or misuse.
We use your health information only to provide the Services to you. We do not sell your personal information, and we never use your health information for advertising.
3. Legal basis
Where data protection laws such as the GDPR apply, we process your account and subscription data to perform our contract with you, your health information on the basis of your explicit consent (given when you enter it), and usage data on the basis of our legitimate interest in keeping the app working and improving it. You can withdraw consent at any time by deleting the information or your account.
4. Who we share it with
We share information only with service providers that help us run the Services, under contracts that require them to protect it and use it only for us:
- Cloud hosting and database providers (to store your account and entries)
- Apple and Google (app distribution and subscription billing), and a subscription-management provider
- Product analytics and crash reporting providers
- Email and push notification providers
We may also disclose information if the law requires it, or as part of a merger or sale of our business, in which case this policy continues to apply.
5. International transfers
Our providers may store and process data in countries other than where you live, including the United States. Where required, we use appropriate safeguards such as standard contractual clauses.
6. How long we keep it
We keep your information while your account is active. When you delete your account, we delete your personal and health information within 30 days, except records we must keep by law (such as transaction records, for up to 7 years).
7. Security
Your data is encrypted in transit and at rest, and access is limited to people who need it to run the Services. No system is perfectly secure, but we work to protect your information and will notify you of a breach where the law requires.
8. Your rights
Depending on where you live, you can ask to access, correct, download or delete your information, object to or restrict how we use it, and withdraw consent. You can delete your account at any time (see how). For anything else, email privacy@fathom-limited.com. You can also complain to your local data protection authority.
California residents: we do not sell or share personal information for cross-context behavioural advertising, and you have the right to know, delete and correct your information without discrimination.
9. Not medical advice
The Services help you track and reflect on your own wellness. They do not diagnose, treat or prevent any condition, and nothing in them is medical advice. Always talk to a doctor about your health.
10. Children
The Services are for adults aged 18 and over. We do not knowingly collect information from children. If you believe a child has given us information, contact us and we will delete it.
11. Changes
We may update this policy. If the changes are significant, we will tell you in the app or by email before they take effect.
